A federal judge has refused to issue a preliminary injunction against the transfer of more than 700 acres of federal wildlife refuge land in Texas to SpaceX, a decision that allows the land exchange to proceed. The ruling was made by U.S. District Judge Fernando Rodriguez Jr., who denied the request from environmental and tribal groups seeking to halt the deal.
The groups had argued that transferring the land, which is part of the Lower Rio Grande Valley National Wildlife Refuge, could pose environmental risks. Despite their concerns, Judge Rodriguez found that the plaintiffs did not present sufficient evidence that the land would face imminent environmental, cultural, or historical damage if the transfer went ahead during the ongoing legal proceedings.
Under the proposed agreement, SpaceX would receive land within the 103,000-acre refuge in exchange for 683 acres of its own property. This land is closer to SpaceX’s rocket launch facility near the U.S.-Mexico border. The U.S. Fish and Wildlife Service has previously concluded that the swap is unlikely to cause significant environmental impacts and may even enhance habitat connectivity and conservation efforts in South Texas.
The environmental groups, however, remain concerned about the potential consequences of SpaceX’s expanding operations on local wildlife habitats and historical sites. They have indicated that they will continue their legal challenge despite the court’s recent decision.
Judge Rodriguez noted that stopping the land exchange could disrupt SpaceX’s development plans and contractual obligations. As the legal battle continues, the case highlights the ongoing tension between conservation efforts and commercial space endeavors.
